Regular Meeting – August 11, 2015

The regular meeting of the Board of Directors for the El Rancho Florida HOA, Inc. was held on August 11, 2015 at 6:00 PM at 280 Sundance Circle.  Present for the meeting were:

Rex Emenegger – Vice President

Teri Roberts – Director

Peter Diethrich – Treasurer

The meeting was called to order at 6:00 PM.  Also present was Eric Sibelius – Irrigation Manager, Kelly Maertin – Property owner and Marsha Moreland, Administrator.

MINUTES:

A motion was made, moved and passed to approve the minutes of the regular meeting on July 14, 2015.

217 CASSIDY DRIVE – MAERTIN, KELLY:

The Board welcomed Kelly Maertin to the meeting.  Kelly reported that the pit bulls and the tenants are removed from the property.  She stated that she really had no idea that there had been problems and had been told by the tenants that the dogs had been kept in a kennel.  She informed the Board that she was appalled by the incident.  The Board reminded Kelly that the ultimate responsibility falls on the property owner.  Legal fees totaled $470.97 and fines of $800 until remedied, as explained by Pete Diethrich, Board member.

A motion was made, moved and passed that the Board will waive the $800 in fines since Maertin did cooperate fully to remove the dogs and tenants.  The Board will not waive the legal fees but will do a payment plan of $150/mo. X 2 months and final payment of $159.97.  As long as Maertin is following the payment agreement there will be no interest.  If she defaults then the unpaid balance is due in full with interest on the unpaid balance.

DITCH REPORT – ERIC SIBELIUS, IRRIGATION MANAGER:

Eric reported that the subdivision ran out of adjudicated water on the 15th of July and that the subdivision is receiving only project water for as long as it lasts.  The subdivision will receive 3 ac ft/day thru September 15th, or as long as it lasts.

ACCOUNTS PAYABLE:

A motion was made, moved and passed approving the payables submitted.

‘JUNK’ – 419 RANCHOS FLORIDA DR.: – TOPPENBERG

The tenant Ramona Neuman is working on cleaning up the property and the Board will follow up with a  visit and letter to be drafted by Rex.

‘NOISY MOTORCYCLES’ – A complaint was made to the Board regarding the noisy motorcycles/bikes at the Krispin residence.  Pete offered to talk with the Krispins.

 

NEW BUSINESS:

  • RULE #29:  ‘Rules are binding on all Tenants/Renters’.

A motion was made, moved and passed to amend the R&Rs to ADD Rule #29.

#29 Rules & Regulations Binding on All Occupants

The governing documents including the “Protective Covenants” and the “Rules & Regulations”

shall be binding upon all occupants including tenants and renters.

  • Weed Violators: Kwaja Chung will receive a letter from the Board regarding the accumulation of weeds at 92 River Front Place.
  • 2700 CR 510: Rex will go and welcome the new owners to the subdivision and remind them that the  Covenants, and the Rules and Regulations allow only  one single family dwelling per property.  A follow up letter will be sent if necessary.
