EL RANCHO FLORIDA HOMEOWNERS ASSOCIATION, INC.

Regular Meeting – July 14, 2015

 

The regular meeting of the Board of Directors for the El Rancho Florida HOA, Inc. was held on July 14, 2015 at 6:00 PM at 280 Sundance Circle.  Present for the meeting were:

Rex Emenegger – Vice President

Kate Pickford – Secretary

Teri Roberts – Director

Peter Diethrich – Treasurer

 

The meeting was called to order at 6:00 PM.  Also present was Eric Sibelius – Irrigation Manager, Claire James – property owner, Gary Skiba – Director of Animal Protection in La Plata County and a property owner of El Rancho Florida Subdivision and Marsha Moreland, Administrator.

MINUTES:

A motion was made, moved and passed to approve the minutes of the regular meeting on June 9, 2015.

CLAIRE JAMES & PIT BULL COMPLAINT:

The Board welcomed Ms. James to the meeting and asked her to review the incident with the pit bulls killing her dog, in her house, on July 28th.  After reviewing the incident, she thanked the Board for getting on top of the situation and hopes that people will be more aware of the unpredictable nature of the breed. As far as she is aware the tenants and the dogs are still there at the property.

A discussion opened on the definition of ‘pit bulls’.  Gary Skiba of Animal Protection for La Plata County gave his opinion as to what changes should be made in the Rules & Regulations that clarify the dog ‘pit bull’.  That is not a breed in itself. The Board reviewed the definition as spelled out by the American Kennel Club.   A motion was made, moved and passed to adopt the amendment that clarifies the  definition of ‘pit bulls’ as stated by the American Kennel Club.  The reference that pit bulls are ‘specifically prohibited ‘will be removed from Rule #15 and  Rule #16 will be more definitive prohibiting pit bulls as defined by the American Kennel Club.

DOG COMPLAINTS:

When someone is making a complaint to the Board, Animal Protection or the Sheriff’s Dept. they need to have the following specifics:

  1. Type of dog.
  2. Where the dog was.
  3. When the dog was seen.
  4. Whether the dog was involved in an ‘incident’ and if the dog was under the control of the owner.
  5. If an incident occurs call 911.

A motion was made, moved and passed to levy a $100/day fine, effective July 14th, to Kelly Maertin until the dogs are removed and compliance is verified.

Kate will call Kelly Maertin about the Board’s decision.  Pete will verify compliance.

DITCH REPORT:

Eric Sibelius reported that the ditch was shut down for a few days at the end of June due to extreme pressure on the head gate.  He is considering putting users of the ditch on a Thursday, Friday, Saturday and Sunday ON and 3 days OFF.  The big pond on Pioneer Circle is leaking quite badly and wasting water.

BEACH IMPROVEMENTS:

The improvements to the beach area at the pond came in at $3600, which was under budget.

WEEDS:

Doug Nie complained that he has been spraying his lot but the property owners around him are not.  Notices will be sent to Julianna, Chung/Dickenson, Metropolitan District and neighbors at the entrance who are not in the Subdivision.  Letters are to go out with copies sent to Rod Cook at the County Weed Office.

A motion was made, moved and passed to ADD Rule #28 from the old Rules and Regulations on ‘Weeds”.

‘JUNK’ AT 419 RANCHOS FLORIDA DRIVE:

Paul Toppenberg’ s renter, Roberta Neuman, is in violation to the Rules & Regulations, Rule #28 on ‘JUNK’.

A motion was made, moved and passed to notify Toppenberg, and Neuman, of the violation and that the lot needs to be brought into compliance with the Rules and Regulations of the Subdivision.  Letters will be sent certified, regular mail and an e-mail to Toppenberg with copies to renter, Neuman.  Numerous complaints from homeowners have been received.

ACCOUNTS PAYABLE:

A motion was made, moved and passed, after reviewing the payables, approving them for payment.

NOTICES ON BILLINGS:

  • Pit bulls are not allowed in subdivision.
  • If you see weeds and especially thistles on someone’s property call La Plata County Weed Office.
  • Encourage residents to utilize the web site and look at the Beach Calendar if they plan to use the beach for large events.
  • If you see ‘dogs at large’ in the subdivision call County Dispatch at 911.

There being no further discussion the meeting was adjourned at 7:22 PM.
